Camlytics Single for desktop, Camlytics Service for desktop, or Camlytics Cloud for web are referred as "Software" further below.
Software licenses
Once activated, licenses for Camlytics Single desktop software can not be revoked. One desktop software license can be activated on one PC only. Change of PC, motherboard or network adapter will lead to invalidation of the Camlytics Single license.
Payments and refunds
All payments received for the Camlytics Single desktop software licenses become non refundable once the corresponding licenses are activated on user's machines.
Camlytics Service subscription can be stopped/cancelled by setting the number of channels and extra storage to zero in the billing section.
Trademarks
Camlytics and other marks indicated on the Site are trademarks of Camlytics or its affiliates. Camlytics graphics, logos, page headers, button icons, scripts, and service names are all trademarks or trade dress of Camlytics or its affiliates (the "Trademarks and Trade Dress"). The Trademarks and Trade Dress may not be used by you in any way, including, but not limited to, use (I) in connection with any product or service that is not provided by Camlytics, (II) in any manner that is likely to cause confusion among customers or (III) in any manner that disparages or discredits Camlytics or its affiliates. All other trademarks not owned by Camlytics or its affiliates that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Camlytics or its affiliates.
Termination
Camlytics may terminate your use or registration with or without cause at any time without notice to you. We reserve the right to discontinue the communication with the customer if they choose to use profanities or threats. In the event of a breach by you of these Terms of Service, any such termination by Camlytics shall be in addition to and without prejudice to such rights and remedies as may be available to Camlytics, including injunction and other equitable remedies. The disclaimer, limitations on liability, indemnity and termination provisions of these Terms of Service shall survive the termination or expiry of these Terms of Service.
Dispute resolution
We will do our best to resolve any controversy or dispute that you may have with us in a satisfactory manner. If we are unable to resolve any such dispute, then either party shall submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.
Indemnity
You agree to indemnify and hold harmless Camlytics, its parents, subsidiaries, affiliates, customers, vendors, officers and employees from any liability, damage or cost (including reasonable attorneys' fees and cost) from any claim or demand made by any third party due to or arising out of your breach of these Terms of Use or your violation of any law or other right of any person or entity.
Registration process
When you submit your registration, you will create a password-protected account to access certain features or functions of this Site. You agree to keep your account information and password confidential. You are responsible for all activities that occur under your account. You may not post or transmit, or cause to be posted or transmitted, any communication designed or intended to obtain password, account, or private information from any other Site user. One account can be used only by one person. You agree to tell Camlytics immediately about any suspected unauthorized use of your account. Camlytics will not be responsible for any loss to you caused by your failure to comply with these obligations.
Age of users
Camlytics does not intend for the Site to be used by individuals under the age of 18 without the supervision of a parent or guardian 18 years of age or older. If you are under 18, you may use the Site only with involvement of a parent or guardian.
Disclaimer
The Software is provided “as is” without warranty of any kind, either expressed or implied and such Software is to be used at your own risk.
The use of Camlytics Software is done at your own discretion and risk and with agreement that you will be solely responsible for any damage to your computer system or loss of data that results from such activities. You are solely responsible for adequate protection and backup of the data and equipment used in connection with any of the Software linked to this website, and we will not be liable for any damages that you may suffer connection with downloading, installing, using, modifying or distributing the Software. No advice or information, whether oral or written, obtained by you from Camlytics or from this website shall create any warranty for the Software.
Additionally, we make no warranty that:
• The Software will meet your requirements.
• The Software will be uninterrupted, timely, secure or error-free.
• The results from the use of the Software will be effective, accurate or reliable.
• The quality of the Software will meet your expectations.
• If errors or problems occur in connection with a download of the Software, they will be corrected.
The Software could include technical or other mistakes, inaccuracies or typographical errors.
We assume no responsibility for errors or omissions in the Software or documentation available from its website.
In no event shall we be liable to you or any third parties for any special, punitive, incidental, indirect or consequential damages of any kind, or any damages whatsoever, including, without limitation, those resulting from loss of use, lost data or profits, or any liability, arising out of or in connection with the use of the Software.
